In order for you to be able to purchase products from Bigfish Gear Australia Pty Ltd and for us to make a legally binding contract with you, you must provide certain information. This includes your real name, telephone number, email address, as well as any other information that we may ask you to provide.

You warrant that the PayPal account, debit or credit card for which you give us the details is yours, that it is valid, and that you have authority to use it for this transaction.

The details you supply will be subject to checks by card issuers. By offering to purchase goods you specifically authorise us to transmit or obtain information about you from third parties, including your debit or credit card number or credit reports. This information may be used to authenticate your identity, validate your card, obtain authorisation and authorise individual purchase transactions.

We reserve the right to refuse any debit or credit card without being obliged to give a reason. Bigfish Gear Australia Pty Ltd reserves the right not to proceed with any order for any reason, and will inform you if this occurs.

Please make sure the product is suitable before ordering, and keep in mind that colours can appear different on screen.

Even though we take reasonable precautions, it is possible that products may be listed with incorrect information due to typographical errors or supplier updates. We may change or update product information at any time.

If we find an error in your order, we reserve the right to cancel the transaction at any time up to delivery, and refund your payment.

We do not make any representations or warranties regarding any product or its fitness for any purpose other than the representations or warranties expressed in this agreement.

Bigfish Gear Australia Pty Ltd will, to the extent permitted by law, not be liable to you or any other person under any circumstances for any loss of use, profit, revenue, interest, goodwill or data, or for any injury or death, or for any indirect, incidental or consequential damages sustained or incurred by you, whether such liability arises directly or indirectly as a result of: any negligent act, omission or willful misconduct of Bigfish Gear Australia Pty Ltd or its employees or agents; the supply, performance or use of any products or services; or any breach by Bigfish Gear Australia Pty Ltd of its obligations under these terms or any relevant sales contract.

Gift vouchers are partially redeemable. Within the validity period, they can be used to make any number of separate purchases up to the value of the voucher, or above the value, in which case the holder must make up the difference with an alternative payment method.

Additional values cannot be added to an existing voucher; however additional gift vouchers can be purchased.

Gift vouchers are valid for 3 years from the date of issue and must be redeemed in full within the validity period. Any unused balance will not be refunded or credited on expiry.

Vouchers are to be treated like cash, are not redeemable for cash, and cannot be used for payment of credit or retailer accounts. They cannot be reloaded. You are liable for all transactions on your gift voucher except where fraud or negligence by us or our employees has occurred.

To redeem, the voucher number code must be entered while making a purchase online at www.bigfishgear.com or mentioned when purchasing over the phone.

All deliveries are subject to approval of online payment. Orders placed on business days between 9am and 5pm (Australian EST) are generally processed immediately. Purchases made outside these hours, on weekends or public holidays may take up to 12 hours to process. Bigfish will not be responsible for late delivery due to postal delays or incorrect information submitted by the purchaser.

Online gift voucher purchases of $1,000 or greater are subject to identity checking. You may be required to provide relevant identification before orders can be processed.
